Conditions d'utilisation

These Terms and conditions of service concern the sale of used items and collectibles from the personal archive of Fabrizio de Gennaro (Seller), carried out remotely via the internet on the website www.e-collecta.it.
The Seller after years of collecting, has decided to get rid of it without speculative intent.
The e-collecta.it site has a temporary existence: once the sale of the archive is complete, the site will be closed.


The Terms and Conditions will apply between the parties to the contract who are:
Seller: e-collecta.it of Fabrizio de Gennaro;
Customer: the subject identified by the data entered when completing and sending the order form electronically with the simultaneous acceptance of these General Conditions (hereinafter referred to as: "Customer").
the legislation on personal data prohibits the Customer from entering false, and/or invented, and/or invented names, in the online order procedure and in further communications. The Seller reserves the right to report any violation and abuse to the competent authority, in the interest and for the protection of consumers and public faith.
Furthermore, the Customer relieves the Seller from any possible error deriving from the issue of incorrect tax documents due to incorrect or incomplete information relating to data provided by the customer, being the same solely responsible for the correct insertion.
These Terms and conditions of the service pertain to the sale of the products displayed on the website of the Seller who reserves the right to modify these Terms and conditions of the service at any time by notifying the Customers by posting them on the Site.


Article 2 . Online sales

By online sales contract we mean the distance contract, i.e. the shop concerning the sale of the "Products" entered into between the Seller and the Customer in the context of a distance selling system organized by the Seller who, for this contract, uses "internet" and related technologies. Therefore, these contracts will be concluded directly through access by the Customer to the website corresponding to the address www.e-collecta.it, where, following the indicated procedures, he will conclude the contract for the purchase of the Product.
For each of the products, a Technical Data Sheet is available on the Site containing the main characteristics and technical specifications of the same, as described by the producers and/or importers and/or by the Seller.


Article 3. Prices.

The Customer can only purchase the Products offered on the site, at the price indicated therein in Euros, taxes and customs duties are not included (shipping costs do not include international taxes and customs duties) by following the procedure indicated on the site itself. Correct receipt of the order is confirmed by a reply via e-mail, sent to the e-mail address communicated by the Customer. This confirmation message will contain the date and time of execution of the order and a "Customer order number", to be used in the event of any communication with the Seller. The message will contain all the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections.
Without prejudice to the possibility, before sending the order confirmation, of requesting the Customer via e-mail for further information with reference to the purchase order placed on the Site.
The prices of are subject to variations: in this sense the Seller will proceed to indicate the new prices with the online update.
Any errors in the publication of prices do not imply automatic acceptance of the order and shipment of the goods by the Seller. At the express request of the Customer to the Seller, the same will issue any receipt of the material sent by sending it to the Customer. For the issuance of the receipt, the information provided by the Customer at the time of the order is valid. Once the receipt has been issued, it will not be possible to make any changes to the data indicated therein.


Article 4 . Product availability.

In the event of unavailability of the Products ordered in the warehouse, occurring after the Customer has placed the order on the site, the Seller will immediately notify the e-mail address indicated by the same and will refund the Customer. In this case the transaction will be cancelled. In this case, any contractual or non-contractual obligation on the part of the Seller is excluded for the failure to conclude the contract.


Art. 5. Acceptance of the General Conditions of Sale.

The Customer, by sending his purchase order electronically, unconditionally accepts and undertakes to observe in his relations with the Seller, declaring that he has read and accepted all the information provided to him, also  acknowledging that the Seller does not is conditionally bound different ions unless previously agreed in writing.


Art. 6. Method of payment.

Payment for the Products purchased by the Customer as well as the related delivery costs can only be made in the following ways:

Credit cards
Bank transfer - 3 to 5 days for receipt

NOT SHIPPED BY CASH ON DELIVERY
The order will leave within 2 (two) days following receipt of payment.



Art. 7. Shipments.

The purchased products will be shipped by the Seller to the address indicated by the Customer. Each shipment is made to the customer with selected couriers. Indicatively, without this entailing any constraint for the Seller and subject to the availability of the products as well as any causes of force majeure, the goods will be delivered to the courier within 2 (two) working days following the acceptance of the order by the Salesperson. Orders will be processed only with goods completely available. Upon receipt of the goods at your home, the Customer will have to check the integrity of the packages, it will be the responsibility of the same to have the courier detect and accurately note the lack of integrity of the package under penalty of forfeiture of asserting his rights in this regard. In any case, the shipment constitutes delivery of the goods which from that moment are out of the Seller's availability.


Article 8 . Product warranty.

The products purchased on the website www.e-collecta.it are subject to the discipline, as far as applicable, pursuant to Legislative Decree 2.2.2002 n. 24 (Official Gazette no. 57, 8.3.2002) on sales contracts and guarantees concerning consumer goods and, to the extent not contemplated therein, to the specific provisions envisaged on the subject by the Civil Code.
When the product is returned to the Seller to be repaired or replaced, it must be complete with the packaging and all the accessories and documentation received from the customer at the time of purchase. The return of the product without the original packaging, the accessories and the above documentation prevents the Seller from replacing the product itself at the manufacturer and makes it impossible to replace it.
In any case, the return must be communicated and agreed with the Seller who must be informed of the return methods with the communication of the courier and any tracking number. The goods being returned travel at the Customer's risk until they are delivered to the Seller.
The Seller reserves the right to verify the actual defect stated by the Customer and to carry out the repair or replacement only after this check. If, following verification by the manufacturer, the defect does not result in a lack of conformity, the Seller reserves the right to charge the Customer for verification and repair costs as well as the related transport costs.


Art. 9. Right of withdrawal

The customer has a period of 14 days to make the return, this period starts from the day of the order placed. Within the deadline, the customer must inform the seller of his decision to exercise the right of withdrawal, by sending an email always specifying the number of his order. The refund will be net of the shipping cost incurred and the return shipping costs will be borne by the buyer. The customer will be refunded immediately after returning the item with the same payment method used during the purchase.

Termination of the contract

Any dispute relating to the application, execution, interpretation and violation of this sales contract is subject to Italian jurisdiction. For any dispute between the parties regarding this contract, the Court of jurisdiction relating to the domicile or residence of the customer, if located in Italy, will be competent on the basis of Legislative Decree 206/2005.
